China Sojourn provides an online travel guide platform focused on travel in China. Our Service includes access to curated travel guides, city and destination information, trip planning tools, community forums, and premium content available through paid subscriptions or one-time purchases.
We strive to provide accurate and up-to-date travel information, including details about attractions, accommodations, transportation, and local customs. However, travel information is inherently subject to change, and we cannot guarantee that all information will be current, complete, or error-free at all times.

Certain features of our Service require payment. All prices are listed in US Dollars (USD) and are subject to applicable taxes. By making a purchase, you authorize us to charge the designated payment method for the total amount, including any applicable taxes.
We use Lemon Squeezy as our Merchant of Record for payment processing. Lemon Squeezy handles all billing, tax collection, and payment transactions. All payment transactions are governed by Lemon Squeezy's terms of service in addition to these Terms. We do not store your full credit card information on our servers. Payments are subject to our Refund Policy, which is incorporated herein by reference.
We reserve the right to change our pricing at any time. Price changes will take effect at the start of your next billing cycle for subscriptions, or at the time of your next purchase for one-time products. We will provide reasonable advance notice of material price changes for subscription services.
All content on the China Sojourn platform, including but not limited to text, graphics, logos, images, photographs, videos, audio clips, data compilations, software, and the design and arrangement thereof ("Content"), is the property of China Sojourn LLC or its content suppliers and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service and its Content for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content without our prior written consent.
Any trademarks, service marks, and trade names used on the Service are the property of their respective owners. The China Sojourn name, logo, and all related marks are trademarks of China Sojourn LLC and may not be used without our prior written permission.
PDF Guide Downloads: PDF guides purchased or downloaded from China Sojourn are licensed for your personal, non-commercial use only. You may not sell, sublicense, rent, lease, lend, redistribute, or otherwise transfer any downloaded PDF guide to any third party, whether for free or for compensation. Each PDF is watermarked with the China Sojourn brand, guide identifier, and license information. Unauthorized distribution of PDF guides may result in immediate termination of your account and legal action under applicable copyright law, including the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
Our Service may include community features such as forums, comments, and user reviews. By submitting, posting, or displaying content ("User Content") on our Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with the operation and promotion of the Service. This license is limited to the purposes described herein and will terminate when you delete your User Content or your account, except for content that has been previously shared with or displayed to other users.

To the maximum extent permitted by applicable law, in no event shall China Sojourn LLC, its officers, directors, employees, agents, affiliates, successors, or assigns be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, regardless of whether such damages are based on contract, tort, strict liability, or any other legal theory.
In no event shall our total liability to you for all claims arising out of or relating to the use of the Service exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In such cases, our liability shall be limited to the fullest extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless China Sojourn LLC and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
This indemnification obligation will survive the termination of your account and these Terms. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defense of such claims.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
Dispute Resolution Hierarchy:
Informal Resolution: Before initiating any formal proceedings, you agree to first attempt to resolve any dispute by contacting us at legal@chinasojourn.com. We will attempt to resolve the dispute informally within 30 days. Many disputes can be resolved without formal proceedings.
Binding Arbitration: If the dispute is not resolved informally within 30 days, you and China Sojourn agree that any claim, dispute, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. You agree that any arbitration under these Terms shall be conducted on an individual basis only, and not as a class action, collective action, or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against China Sojourn. The arbitrator may award any relief that a court of competent jurisdiction could award, including injunctive relief.
Court Proceedings: Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights. Additionally, EU consumers retain the right to seek resolution in their local courts, notwithstanding the arbitration clause above.
We reserve the right to revise and update these Terms of Service at our sole discretion. We will provide at least 30 days' advance notice of material changes by posting the updated Terms on this page with a revised "Last updated" date and, for registered users, by email notification. Changes will take effect upon expiration of the 30-day notice period.
Your continued use of the Service following the effective date of revised Terms means that you accept and agree to the changes. If you do not agree to the modified Terms, you should discontinue your use of the Service before the changes take effect.
